Scope of Application of This Agreement

article 1
  1. Any Accommodation Contract and related agreement to be concluded between Albida Hotel (“the Hotel”) and its Guest shall be in accordance with the provisions of these agreements, and any matter not provided for herein shall be in accordance with applicable laws and regulations and/or generally accepted practices.
  2. Not withstanding the preceding paragraph, if the Hotel may apply the provisions of any Special Contract insofar that said Special Contract is within the applicable laws and regulations, this Special Contract shall have the priority.

Application of the Accomodation Contract

  1. The person seeking to apply for an Accommodation Contract with the Hotel shall provide the Hotel with the following information.
    • (1) Name of the Guest
    • (2) Date(s) of Stay and Eestimated Arival Time
    • (3) Accomodation Fees
    • (4) Other Information Deemed Necessary by the Hotel
  2. In the case when a Staying Guest requests, during her stay, an extension of the accommodation beyond the date(s) of the stay in the item (2) of the preceding paragraph, it shall be regarded as an application for a new Accommodation Contract at the time such request is made.

Concluding the Accomodation Contract

article 3
  1. An Accommodation Contract is concluded when the Hotel accepts the application as described in the preceding article. If the Hotel proves that the contract was not accepted, this article does not apply.
  2. When an Accommodation Contract is concluded according to the preceding provision, the Guest is responsible for paying the reservation deposit for her staying period up to the amount of the basic accommodation fees (when the accommodation period exceeds three days, the deposit shall be the three-days worth accommodation fees) by the due date designated by the Hotel.
  3. Paid reservation deposit shall be included in the final payment of the Guest accommodation charges. When the matter under the subject to Article 6 and Article 17 occurs, the reservation deposit set forth in the preceding paragraph shall be applied for the payment of the penalty fee followed by compensation, and then any remainder thereof, if any, shall be reimbursed at the closing payment according to the Article 12.
  4. When the reservation deposit stipulated in preceding paragraph 2 is not paid by the designated day determined by the Hotel, the Accommodation Contract shall be cancelled. This applies only when the Hotel sent the notification of the designated deadline for the deposit payment to the Guest.

Special Contract for a waver of deposit payment

article 4
  1. Despite the matter stipulated in preceding Article paragraph 2, the Hotel may accept the application under special contract which wave the payment of the deposit described in same paragraph after the conclusion of the Accommodation Contract.
  2. In the case when the Hotel does not request the deposit payment under the preceding Article paragraph 2, or not specify the deadline of the payment at the time of conclusion of the Accommodation Contract, the contract is considered as a Special Contract.

Refusal of concluding Accomodation Contract

article 5

The Hotel may refuse the conclusion of an Accommodation Contract in the event of the followings.

  • (1) When the application for accommodation does not conform to the provisions of this agreement.
  • (2) When the Hotel is fully booked and no room is available.
  • (3) When the person seeking accommodation is deemed liable to conduct himself/herself in a manner that will contravene the applicable laws or be against the public order or good morals in regard to his/her accommodation.
  • (4) When the person seeking accommodation is deemed to be one of the following a〜c.
    • Being an organized crime groups (“Organized Crime Group”) specified under the Act on Prevention of Unjust Acts by Organization Crime Group Members or being a gangster (“Gangster”) under the same law above, or sub-member or related to such a Organized Crime Group or other antisocial force.
    • Being a corporation or other group whose business activities are under the control of the Organized Crime Group or Gangsters.
    • Being a corporation or other group with a board member or director who is a member of Organized Crime Group.
  • (5) When the Hotel staff (employee) determines that the person seeking an accommodation may cause serious annoyance to other Guests by being drunk or other disorderly behavior, or the Guests conducted themselves in a manner that caused serious annoyance to other Guest.
  • (6) When the person seeking accommodation can be clearly detected as carrying an infectious disease.
  • (7) When the person seeking accommodation seeks to use intimidating illegitimate demands such as violence, intimidation, blackmailing the Hotel or the Hotel staffs (employees), and the Hotel is requested to assume an unreasonable burden in regard to the person’s accommodation, or has confirmed to have had previous experiences as described above.
  • (8) When the Hotel is unable to provide accommodation due to natural disasters, malfunction of the facilities, or other unavoidable causes.

Accomodation Contract cancellation rights of the Guest

article 6
  1. The Guest is allowed to cancel the Accommodation Contract by contacting the Hotel.
  2. In the case where the applicant has cancelled the Accommodation Contract in whole or in part (when the Hotel request the deposit payment with payment deadline according to the Article 3, Paragraph 2, and the applicant has cancelled the contract before the payment deadline), he/she shall pay to the Hotel the contract cancellation fee. In the case when the Hotel accept the Special Contract under the Article 4 Paragraph 1, the applicant has the obligation of pay the penalty fee only if the Hotel has notified the Guest regarding the payment duty of cancellation penalty fee.

  3. In the case where the Guest does not appear without any advance notice by 1:00am on the next day of the accommodation date (or when it passes the estimated time of arrival if such estimated time was expressly informed beforehand), the Hotel may regard the Accommodation Contract as being cancelled by the Guest and treat it as such.

Accommodation Contract cancellation right of the Hotel

  1. The Hotel may cancel the Accommodation Contract in the event of the following.
    • (1) When the Guest is deemed liable to conduct himself/herself in a manner that will contravene the applicable laws or be against the public order or good morals in regard to his/her accommodation.
    • (2) When the Guest is deemed to be one of the following a〜c.
      • Being a Organized Crime Groups, being a gangsters or sub-member of gangstars, related to such a Organized Crime Group or other antisocial force.
      • Being a corporation or other group whose business activities are under control of the Organized Crime Group or gangster.
      • Being a corporation or other group with a board member or director who is a member of Organized Crime Group.
    • (3) When the Guest behaves in a manner that causes serious annoyance to other Guest(s) of the Hotel.
    • (4) When the Guest is deemed to be clearly detected as carrying an infectious disease.
    • (5) When the Guest seeks to use intimidating illegitimate demands such as violence, intimidation, blackmailing the Hotel or the Hotel staffs (employees), and the Hotel is requested to assume an unreasonable burden in regard to the person’s accommodation, or has confirmed to have had previous experiences as described above.
    • (6) When the Hotel is unable to provide accommodation due to natural disasters or other unavoidable causes.
    • (7) When the Guest smokes in the bed, vandalizes fire protection equipment/facilities or break the Hotel’s rules (limited to the necessary rules for fire prevention).
  2. When the Hotel cancels the Accommodation Contract according to the preceding paragraph, the Accommodation Charges for the Guest has not been received such as accommodation fees for the date after cancellations shall not be charged.

Registration for accommodation

article 8
  1. The Guest shall register the following information with the Front Desk of the Hotel.
    • (1) Name, age, sex, address & occupation of the guest
    • (2) In case of the foreign guest, nationality, passport number, the location & date of the entry into the country
    • (3) departuer date and approximate depature time
    • (4) Other information the Hotel deems to be necessary

Guest Room Hours

  1. a Staying Guest may use a guest room of the Hotel from 17:00 to 10:30 the next morning.
  2. Despite stated preceding paragraph, the Hotel may accept the request of extension of the stay. In this case, the Hotel will charge additional fees.

Compliance with the Hotel Usage Rules

A Staying Guest is expected to follow the Hotel usage rules which the Hotel determines and posts in the Hotel.

Hours

  1. The business hours of the major facilities of the Hotel is set as below. The guest can find detailed information on the notice boards and service directories throughout the Hotel.
    • (1) No curfew. However, the front entrance will be locked at 24:00, midnight.
    • (2) Front Service : 24/7
  2. Hours above may change temporally due to unavoidable circumstances. In this case, the Hotel will send a notice to the guests via a proper method.
  3. The front entrance is locked for security after midnight. For a check-in during night hours, our staff confirms the visitor via the monitor and unlocks the door.

Fee Payment

  1. The breakdown of the fees to be paid by a Staying Guest is calculated according to the Hotel’s basic fee chart.
  2. The fees are to be paid at the front desk by cash, a credit card approved by the Hotel, etc. at the time of the Staying Guest’s departure or upon the Hotel’s request.
  3. When the Hotel provided a room for a Staying Guest and made it available for use, even if the Staying Guest chooses not to stay in the room, the Hotel shall charge the payment for the stay.
  4. In an accomodation plan with added services, i.e. breakfast, even if the guest chooses not to eat, drink, or use the services, the Hotel shall charge the related fees.

Responsibilities of the Hotel

  1. In execution or failure of execution of an Accomodation Contract and related contracts, when the Hotel caused any damage to a guest, the Hotel shall compensate for the damage. If the damage was caused by a reason outside of our responsibilities, the compensation shall not apply.
  2. The Hotel has a liability insurance contract to deal with possible fire and other disasters.

In the Case the Hotel cannot Provide the Contracted Room

  1. If the Hotel cannot provide the room contracted for a Staying Guest, upon the agreement from the Guest, the Hotel shall refer another lodging facility with as similar accomodations as possible.
  2. Nonetheless, when the Hotel cannot refer another lodging facility, the Hotel shall pay the compensation appropriate for the penalty for breaching the Contract, and the compensation shall be applied to the payment amount. However, if the room was not available due to a reason outside of the Hotel’s responsibilities, the compensation shall not be paid.

Handling of Belongings

  1. The guest shall be individually responsible for her belongings brought into the premise. The Hotel provides a combination lock, and the guest, upon agreement, uses the safe-keeping facilities withing the Hotel. In the case of a damage or loss of the belongings, the Hotel shall not take any responsibility whatsoever.
  2. When a Staying Guest brings articles, cash or valuables into the Hotel, the Guest shall be responsible for them, and the Hotel basically does not offer services to keep them. The Hotel shall not be responsible whatsoever for the loss of the Guest’s belongings.

Keeping the Staying Guest’s Luggage or Personal Items

  1. Basically, the Hotel does not accept any delivery of luggage. However, in the limited case where the Hotel agrees beforehand, the Hotel accepts the shipped luggage before the Staying Guest arrives. The Hotel takes responsibility to keep it safe and hands the luggage over to the Staying Guest at the time of her check-in at the front desk. If there is no request beforehand, the Hotel accepts no delivered luggage.
  2. After a Staying Guest checked out, leaving her luggage or personal items in the Hotel, if the owner was found, the Hotel will contact the owner and ask for a direction. In the case of no direction from the owner or no owner is found, the Hotel shall keep the items for 7 days including the day the items were found, and take them to a nearby police station afterwards.
  3. The Hotel takes no responsibility regarding the safe-keeping of Staying Guest’s luggage or personal items as set forth in Article 1.

Responsibilities of Staying Guests

Either a Staying Guest’s intention or negligence causes the Hotel a damage, the Staying Guest must pay a compensation.

Measures against Disasters

article 18

The Hotel requests your cooperation in preventing disasters such as fire or earthquake. In the case of emergency, please stay calm and follow the directions from the staff.Also, be prepared for the unexpected by checking the locations of emergency exit and a fire extinguisher as well as how to evacuate.

Terms of Use

In order to ensure a safe and comfortable stay for Guests, the Hotel set forth the Facilities’ terms of use (“Terms”) acording to the Article 10 of the Accomodation Contract. We sincerely ask for your cooperation in keeping the Terms.If you fail to follow the Terms, the using privilage of the Facilities within the Hotel (as defined in the Article 1) shall be denied.We would like to call your special attention – if failing to adhere to the Terms results in an accident, you may be responsible for it.

Scope of Application

The Terms apply to all visitors who use the Hotel’s any facility (sleeping accomodation, lounge, shower room, roof, cafe, etc. “Facilities within the Hotel”). To the guests who stay at the Hotel (“Staying Guests”), the Terms are applied as well as the accomodation contract (“Accomodation Contract”) set forth by the Hotel.

For Your Safety and Security

  • The diagram of mergency exit from the bedroom/capsule bed area is posted in the elevator hall or available by scanning the QR code posted in the bedroom. Be sure to check it.
  • Whenever going out of the bedroom/capsule bed area, please do take the IC card key with you.
  • During your stay, if you find anything suspicious, immediately call the front desk using the internal phone in the elevator hall. Visitors other than registered guests are not allowed to stay, and please refrain from seeing visitors anywhere else except on the reception floor.
  • Smoking is not allowed in the Hotel, including the bedroom/capsule bed area. If smoking is sighted, a cleaning fee may be charged.
  • Please refrain from bringing a heat source such as heating/cooking devices or an iron into the bedroom/capsule bed.
  • Please refrain from using products or taking actions that may cause fire hazards.
  • Please stay away from the backyard, emergency exit, mechanical room, and other areas not for guests.
  • To ensure a comfortable stay for all guests, we request not to bring children 12 years old or younger.
  • Children in middle school or older needs an agreement form from a custodial guardian.

Valuables and Belongings

Guests are responsible for their own valuables.Lost-and-found items, unless directed specifically, will be basically kept for 7 days from the date received or found by us. After that, it will be handled according to the procedures set by law.However, for Staying Guests, Accomodation Contract articles 16-2 and 16-3 are applied. Also, in the case of a request to keep the item for the Guest, if the Guest does not retrieve it according to the request, the same procedure as above will be followed.

Payment

We request the payment of fees upon your arrival.Transactions are made with Japanese yen, credit cards, certain prepaid digital money. Other means are not accepted or exchanged. We appreciate your understanding.We do not loan money for your expenses such as airplane, train, bus, taxi or shipping your luggage.

Untisocial Forces Prohibited to Use Facilities

article 5

A group or an individual listed below are prohibited from using Facilities of the Hotel. Also, after a reservation was made or in the middle of using Facilities, once the untisocial fact becomes evident, all the use of Facilities are prohibited against such individual/group from that moment on.

  • A member of an organized crime group defined by Act for the Prevention of Wrongful Acts by Members of Organized Crime Groups (Act No. 77 of 1991, Article 2-2 defines organized crime groups (“Organized Crime Groups”). A member of an Organized Crime Group defined by Article 2-6 (“Members of Organized Crime Groups”). A semi-regular or an affiliate of an Organized Crime Group. Other antisocial force.
  • A corporation or group where Organized Crime Group or their Members run the enterprise.
  • A corporation where an officer/officers fits/fit the definition of Members of Organized Crime Group.
  • When violence, assult, intimidation, extortion, threatening, unreasonable demand or any similar action is recognized.

Please Refrain from:

  • Bringing articles into the Hotel facilities that may disturb other guests,
    • extreme amounts of luggage or articles,
    • guns, knives, swards, and/or drugs prohibited by law,
    • articles with strong odor or smell,
    • animals/pets such as a dog, cat, bird, except for guide dogs and service dogs,
    • flamable powder or solvent and other dangerous items,
    • or other items probited of the possession by law.
  • When using a cell phone, please use the basement lounge or the reception area on the 1st floor and refrain from a call in the bedroom. Please turn on the airplane mode within the Facilities.
  • Using the lobby or bedroom for a business purpose.
  • Selling goods without the Hotel’s permission or distributing advertisement in the Facilities.
  • Using photographs taken inside Facilities of the Hotel without permission for a business purpose. It may incur an legal action.
  • Leaving belongings in the hallway or lobby.(If left for a long time, we may check the content and/or keep them in another area.)
  • Gambling, conducts that disturb public morals/peace, or actions that inconvenience/offend other guests.
  • Loud voice, loud singing, or noisy actions that may disturb other guests in the Facilities of the Hotel.
  • Going outside of a capsule bed in underware.
  • Persons not registered to stay are not allowed to stay.
  • Facilities are completely no-smoking. When smoking is sighted, a cleaning fee may be charged.
  • For the comfort of all guests, please refrain from bringing children 12 years old or younder.
  • Children who are under 13 years old can not say though with elders. Under 13 years old to 20 years old needs permission form prepared and signed by parents to stay, please send the form via e-mail in advance and bring the print-out the day of stay.

  • If a guest is recognized to be in a debilitating condition, not in a sane mind due to drug consumption, etc., has difficulty to be safe, or affects others with excess fear, the Hotel may deny the use of the Facilities to the guest.
  • While using the Facilities within the Hotel, please do not use them for other purposes besides the original purposes designated for each specific location.
  • Intentionally or unintentionally, damaging, soiling or losing the Hotel’s building, equipment, or other items may incur a charge for compensation.
  • Damaging, soiling or losing the Hotel’s building, equipment, or other items for a cause other than force majeure may incur a charge for compensation.
  • Except in emergency, do not enter into emergency stairs, the tower on the roof, mechanical room, etc.
  • Other actions that the Hotel regards as inappropriate.
